Widow awarded nearly £10k

A woman whose husband died as a result of exposure to asbestos has been awarded a payout of £9,500.

During a recent hearing, Lord Brodie ruled that Elizabeth Stuart was entitled to the compensation after the defendants admitted that her husband's exposure to the dust of the insulating material was negligent, the Edinburgh Evening News reports.

George Stuart died at the age of 89 from asbestosis, a chronic and incurable lung condition which results in shortness of breath.

Ms Stuart subsequently launched legal proceedings against the Advocate General for Scotland, representing the ministries of defence and environment - which is where Mr Stuart had worked.

In a written judgement, Lord Brodie said: "I consider that the deceased's estate is entitled to damages by way of reparation in respect of a period of about 18 months, or just a little more, during which the deceased was significantly disabled by reason of breathlessness."
